TERMS AND CONDITIONS

General terms and conditions, as of June 2026

1. CONCLUSION OF THE CONTRACT

A contract is deemed to have been concluded once a written confirmation of the booking has been issued by Restaurant Pata Negra and signed by the contracting party. The contractor is Restaurant Pata Negra. The reservation of rooms or areas constitutes a tenancy. Subletting or passing on such rooms or areas requires the written consent of Restaurant Pata Negra.

2. SERVICES; PRICES

All prices quoted for services at Restaurant Pata Negra are inclusive prices. They include statutory VAT and service. Should the statutory VAT rate change after the contract has been concluded, the agreed price changes accordingly. The charges for providing the rooms or areas are as set out in the respective contract.

Services that have been paid for but not used cannot be refunded. If more than 4 months pass between the conclusion of the contract and the provision of the service, Restaurant Pata Negra reserves the right to change prices without prior notice.

3. CANCELLATION PERIODS / WITHDRAWAL

We require written notice of the exact number of guests no later than 2 days before the event. After that we charge 80% of the booked order, allowing for a goodwill deduction. In this case the charge for the food is based on the guaranteed number of guests even if fewer guests attend. If the stated number of guests is exceeded, the actual number of guests is decisive for calculating food and drinks.

If the organiser has booked Restaurant Pata Negra exclusively, a cancellation period of 2 weeks before the start of the event applies. In the case of a later cancellation we allow for a goodwill deduction and charge 80% of the booked order.

In addition, the conditions set out in the catering contract apply. If a minimum turnover was agreed in the catering contract and this minimum turnover is not reached, the difference is charged as room rent.

4. PAYMENT TERMS

Our invoices are due immediately and payable without deduction. The contractor is entitled to charge default interest of 8% above the applicable ECB rate. The client is liable for payment of any additional food, drinks etc. ordered by the participants of the event. For the reservation of rooms, an advance payment of 30%–50% of the expected turnover may be required.

5. LIABILITY

The contracting partners of Restaurant Pata Negra, or the guest as such or as a host, are jointly and severally liable to Restaurant Pata Negra in full for damage caused by themselves, their guests or third parties engaged by the client. It is the organiser’s responsibility to take out appropriate insurance for this. Restaurant Pata Negra may request proof of such insurance. Use of the rooms provided to the guest that deviates from the agreement entitles Restaurant Pata Negra to terminate the contractual relationship without notice, without this reducing the claim to the agreed remuneration.

Insofar as Restaurant Pata Negra procures third-party services, technical or other equipment from third parties on behalf of the organiser, it acts in the name and for the account of the organiser; the organiser is liable for the careful treatment and proper return of such equipment and indemnifies Restaurant Pata Negra against all third-party claims arising from the provision of such equipment.

Delivery, installation, dismantling and removal of exhibition items and other objects are carried out by the client at the client’s sole risk. Details are to be agreed with Restaurant Pata Negra one week before the start of the event. On request, and as far as possible, assistants for transport and installation will be provided against separate payment. Restaurant Pata Negra is not liable for damage to or loss of items brought onto the premises.

Restaurant Pata Negra is liable for lost or damaged exhibits belonging to the client only if its legal representatives or vicarious agents acted intentionally or with gross negligence.

The client and the organiser are liable, irrespective of fault, for damage to and/or loss of fittings and/or inventory of Restaurant Pata Negra in connection with the event.

6. SPECIAL NOTES

Bringing your own food and drinks requires the prior consent of the management. In such cases a service fee or corkage fee of at least €15.00 including VAT is charged.

Decorative material must comply with fire safety requirements and – like all other objects – may only be installed with the consent of Restaurant Pata Negra. Attaching decorative material to the walls using adhesives, adhesive tape, staples, nails or screws is prohibited. Any resulting damage will be invoiced to the organiser. At the end of the event, all items brought in must be removed from the restaurant.

Should faults or defects occur in the technical or other equipment provided by Restaurant Pata Negra, the restaurant will, as far as possible, remedy them immediately. Restaurant Pata Negra is liable for any damage suffered by the client only if such damage is based on intentional or grossly negligent conduct.

Use of the name and/or the brand „Restaurant Pata Negra“ for any purpose requires written consent. All audio and image rights for recordings made at Restaurant Pata Negra pass to Restaurant Pata Negra.

7. Consumer Dispute Resolution Act / ODR Regulation

The company (Pata Negra) is not obliged and does not undertake to participate in dispute resolution proceedings before a consumer arbitration board.

8. GENERAL PROVISIONS

All amendments must be made in writing. The client and the organiser are jointly and severally liable for all obligations arising from this contract. Should individual provisions of the contract be invalid, this does not affect the validity of the remaining provisions.

The contract is governed by the law of the Federal Republic of Germany. The place of performance and exclusive place of jurisdiction for all disputes arising from the business relationship is Leipzig.
